Mark Wagoner

Mark has a record of success in high-stakes jury trials. In the fall of 2023, Mark defended the lead defendant against felony charges brought by the U. S. Department of Justice, Antitrust Division alleging bid rigging and price fixing contracts issued to the U. S. Army. After a three-week jury trial in the U. S. District Court for the Middle District of Florida, Mark secured not guilty verdicts on all charges for his client. Press accounts referred to his closing argument as a tour de force and the final nail in the coffin of the prosecutions case. Mark has been recognized as one of Ohios top constitutional litigators, with the distinction of representing the Governor of Ohio, the Ohio Secretary of State, the President of the Ohio Senate, and a former Speaker of the Ohio House of Representatives in a variety of high-stakes matters in federal and state courts. Finally, Best Lawyers in America recognized Mark as the Appellate Lawyer of the year in 2021 when he was part of a litigation team that reversed a preliminary injunction in the U. S. Court of Appeals for the Sixth Circuit with a decision that is now widely cited on the duty to deal with competitors under antitrust laws.
