Richard B. Tomlinson

Richard Tomlinson has been representing employers and executive level employees for almost 40 years. An accomplished litigator, Richard has expertise litigating all matters of employment law, including statutory claims under the Americans With Disabilities Act, Family Medical Leave Act, Title VII (Civil Rights Act of 1964) and claims under Michigans Elliott-Larsen Civil Rights Act as well as related tort claims such as defamation, tortious interference with contract and intentional infliction of emotional distress. Richard also advises employers on matters ranging from hiring to termination before employment decisions are made to protect a business from costly litigation expenses down the road. For executive level employees, Richard provides assistance in negotiating and structuring employment agreements and provides advice with respect to severance packages in addition to pursuing employment law claims in state or federal court. Richard also has over 30 years experience in litigating complex commercial cases and contract disputes. Richard has tried over 80 cases during his career, including matters in Oakland, Wayne, Macomb, Jackson, Monroe, Genesee and Washtenaw County Circuit Courts, the U. S. District Courts for the Eastern and Western Districts of Michigan and trial courts in Illinois and Tennessee. These cases have included claims of sex discrimination, sexual harassment, age discrimination, race discrimination, disability discrimination, retaliation, constructive discharge, violation of the Whistleblowers Protection Act. Trials in commercial cases have included claims for breach of contract, shareholder litigation in closely held corporations, partnership disputes and litigation under the Uniform Commercial Code.
