Representative Experience Representation of a judgment creditor seeking to determine numerous entities to be alter egos of a judgment debtor. Judgment was obtained to that effect and full recovery followed. Representation of Judgment Debtor before the Supreme Court of Oklahoma in a matter of first impression regarding judicial powers over such individuals. A Writ of Prohibition was obtained in the Judgment Debtors favor. Representation of Banks interests in a matter involving a parents fraudulent transfers of assets to his adult children in an effort to avoid a substantial debt owed to the Bank. That representation resulted in a settlement between the parties pursuant to which the Banks debt was paid in full. Representation of aggrieved heir in a contested probate matter. The Personal Representative refused to distribute estate assets and was using them for her own benefit. The Personal Representative was enjoined from continuing that practice and ordered to close the Estate. She also suffered a loss of her proportionate share of the Estate as a sanction for her conduct. As one of several attorneys, representation of the Oklahoma Department of Human Services in a class action initiated by a charitable organization regarding the treatment of children in foster care. The case was litigated intensely by all interested parties and resulted in a settlement believed to be in the best interests of the several thousand children affected. Successfully filed suit against a municipality to recover the retainage due a general contractor for the renovation of a wastewater treatment plant. The municipality counterclaimed for liquidated damages tied to delayed completion of the plant during the Covid emergency. Successfully negotiated payment of the entire amount claimed and all of the attorneys fees incurred.
