Elliott S. Cappuccio is an Equity Shareholder in RMWBHs Litigation and Community Association Law sections. Elliott guides clients through complex commercial litigation, business litigation, bankruptcy litigation, and commercial construction law issues. He also represents hundreds of property owner associations (POAs) across Texas in the collection of delinquent assessments and the enforcement of governing documents. Elliott is also frequently called upon to serve as a mediator, using his extensive litigation experience to help parties settle a variety of civil cases. In his over 25-year career, Elliott has gained extensive litigation and trial experience in cases involving torts, breach of contract, business and partnership disputes, fraudulent transfers, breach of fiduciary duty, deceptive trade practices, construction defects, civil RICO, securities fraud, complex collection matters, and POA disputes. His clients range from Fortune 500 companies and mid-size businesses to small businesses, POAs, and individuals. Elliott has garnered numerous honors and accolades in his career. He is Board Certified as a Civil Practice Advocate by the National Board of Trial Advocacy. He is AV rated Preeminent by Martindale-Hubbell, has been named as a Texas Super Lawyer by Texas Monthly from 2007 - 2024 and among the Best Lawyers in America from 2018 - 2024 in the areas of commercial litigation and bankruptcy litigation. He is also the recipient of the Outstanding Lawyer Award in the area of litigation from the San Antonio Business Journal. Away from the office, Elliott volunteers his time with numerous organizations across Texas. He serves as a member of the Community Association Institute (CAI), and is a former president of the San Antonio Chapter of CAI. Since 2011, Elliott has been a member in the Fellows of the Texas Bar Foundation, the largest charitably funded bar foundation in the country, with members selected for their outstanding achievements and demonstrated commitment to the improvement of the justice system in Texas. Elliott graduated with honors from The Catholic University of America, and he received his law degree from St. Marys University Law School.
