Full Bio Mr. Bain is an experienced real estate and business litigator, representing individual and business landowners facing the prospect of losing their properties or businesses to condemnation by a government or utility for the construction of road, power line, gas line, park, or other public use. Mr. Bain also represents landowners in disputes involving their real estate, such as boundary line disputes, trespasses, encroachments, construction disputes, liens and foreclosures. Additionally, a large portion of Mr. Bains practice involves representation of individuals and businesses in litigation and disputes concerning insurance coverage and general business and commercial matters. Prior to joining FCW, Mr. Bain worked in different sectors of the legal industry, having worked for Atlanta law firms representing insurers and their insureds, governmental entities, and banks. Throughout his career, Mr. Bain has gained experience for and against governmental agencies, banks, and insurance companies, culminating in his current practice of representing individuals and businesses in matters that often require knowledge of these entities. From eminent domain to insurance coverage disputes, to personal injury actions, Mr. Bain brings his varied experience to bear on a clients case to try and obtain a favorable solution. Mr. Bain graduated from the University of Georgia, magna cum laude, with a degree in political science and obtained his law degree from the University of Georgia School of Law. Mr. Bain lives with his wife and three children in Alpharetta, Georgia. When he is not working, Mr. Bain enjoys spending time with his family, participating in activities with his church, Alpharetta First United Methodist Church, and following local sports, particularly the Georgia Bulldogs. Negotiated six-figure settlement more than six times the governments original offer, while avoiding lawsuit, in governments taking of a portion of landowners residential property for widening of a road. Obtained settlement from county more than eight times original offer in a condemnation lawsuit filed to acquire property to construct a sidewalk. Obtained six-figure recovery without filing lawsuit from insurance company for erosion issues and damage to lake and dam resulting from negligent construction by contractor. Represented professional client who had defaulted in a lawsuit alleging professional negligence and negligent construction, defeating plaintiffs effort to obtain default judgment and ultimately negotiating settlement of case involving no liability. Resolved a bad faith denial of insurance claim by forcing insurer to provide coverage for construction client in million-dollar dispute. Obtained summary judgment for defendant in case seeking judgment on note and guaranty in a business purchase dispute. Negotiated settlement in Federal Court allowing client to avoid liability on guaranty of over $3,000,000 in bank debt.
