A description of some of his significant trials and appeals are listed below (Curts clients marked with asterisks): United States v. IARA (W. D. MO. 2010). Successful defense of charges for violation of International Emergency Economic Powers Act. United States v. *Kathryn Shields, et al. (W. D. Mo. 2007). One-month jury trial of criminal mortgage fraud conspiracy case, resulting in the acquittal of client of all charges (other two defendants convicted by jury). Prior to trial, government obtained guilty pleas from seven alleged co-conspirators, all of whom testified for the government at trial. United States v. *Tula Turner, et al. (S. D. Tex. 2001). Two-month jury trial of criminal price-fixing conspiracy case, resulting in acquittal of client who was charged as ringleader of nationwide price fixing conspiracy in metal building insulation. Prior to trial, government had successfully prosecuted or obtained guilty pleas from several alleged co-conspirators, all of whom testified for the government at trial. United States ex rel. Bay Insulation, Inc. v. Supreme Insulation Co. (S. D. Tex 2002). Successful defense of qui tam action brought by subcontractor alleging violations of Federal False Claim Act for overpricing of fiberglass insulation for government buildings. United States ex rel. Spartan Technology, Inc. v. Honeywell, Inc. (N. D. Ariz. 2000). Successful defense of action seeking fines for environmental contamination by heavy metals used in manufacture of triggers for nuclear weapons. Nail v. *Mueller and MTW Corp. (Kan. Dist. Ct. 2005). Jury verdict in favor of client in $22 million breach of stock option case. Network 2000 Communications Corporation, et al. v. *Sprint Corporation (Mo. Cir. Ct. and AAA Arbitration 1996). Successful defense of class action for fraud and tortious interference claims totaling over $500 million relating to a class of independent sales representatives obtaining long-distance customers for Sprint. Vantage Investments v. *Holiday Inn, Inc. (W. D. Mo. 2005). Jury verdict in favor of client in franchise termination case. Clark Equipment Co. v. *Harlan Corp., 539 F. Supp. 561 (D. Kan. 1985). Court-tried case resulted in judgment for client on Lanham Act claims. Bain v. *Champlin Petroleum Company (W. D. Mo. 1981), 692 F.2d 43 (8th Cir. 1982). Jury verdict in favor of client in Sherman Antitrust Act §§ 1 and 2, Robinson-Patman Act, breach of contract, breach of fiduciary duty case. *The Kansas Power and Light Company and *Kansas Gas and Electric Co. v. Amoco Corp., Williams Natural Gas Co., Occidental Petroleum Co., and Cities Service Co., see 866 F.2d 1289 (10th Cir. 1989); 1990 WL 136788, 155542, 155543 (D. Kan. 1990). After two weeks of trial in Sherman Act price fixing case, settlement reached in favor of clients in an amount in excess of $200 million. *McCaw Communications, Inc. d/b/a Cellular One v. Cellular Sales, Inc. (Kan. Dist. Ct. 1991) (breach of franchise agreement noncompetition provisions by franchisee; counterclaims of franchisee for unlawful franchise termination, unfair competition and state antitrust violations). Judgment after trial against defendant for $600,000; defendants counterclaims dismissed prior to trial. *Harris v. Missouri Gaming Commission (Mo. Cir. Ct.), 869 S. W.2d 58 (Mo. Sup. Ct. 1993). Constitutionality of Missouri Riverboat Gambling Act held unconstitutional after trial to court and direct appeal to Missouri Supreme Court.
