Justin R. Sawyer

Mr. Sawyer joined the Moses firm in 2021 after having practiced law at a prominent New Mexico law firm for over a decade. He has a multifaceted commercial litigation practice, including foreclosures, creditor rights, real estate litigation, bankruptcy, business litigation, and tribal law. He has extensive experience in judicial foreclosures, representing banks, mortgage companies, mortgage loan servicers and other financial institutions, specializing in complex contested commercial and residential foreclosures. He has defended financial institutions against various claims including alleged violations of the Unfair Practices Act, Home Loan Protection Act, Real Estate Settlement Procedures Act, and breach of contract claims. Mr. Sawyer has represented buyers and sellers in various real estate matters from lien priority litigation and contractor disputes to boundary and zoning disputes and prescriptive easements. He often represents creditors in bankruptcy cases and bankruptcy adversary actions, and advises clients in matters involving the Uniform Commercial Code. In addition to Mr. Sawyers commercial litigation, bankruptcy and judicial foreclosure experience, he represents skilled nursing facilities in connection with appointing guardians and/or conservators for residents who are no longer capable of making financial and healthcare decisions and who do not have family or friends to help make such decisions. Mr. Sawyer also has a robust transactional practice that includes real estate, corporate governance, mergers and acquisitions, and other general business matters. Outside the office, Mr. Sawyer enjoys spending time in the mountains with his wife and two sons rock climbing, skiing, mountain biking, and backpacking.
