Successfully arguing to the First Circuit that the denial of confirmation of a Chapter 13 bankruptcy plan is not a final order subject to automatic appeal. Bullard v. Hyde Park Savings Bank, 752 F.3d 483 (2014). This decision was affirmed by the United States Supreme Court in a unanimous decision on May 4, 2015. Bullard v. Blue Hills Bank f/k/a Hyde Park Savings Bank, 135 S. Ct. 1686 (2015). Andy served as co-counsel in the Supreme Court proceedings. Successfully represented developer of proposed 40B project before the Massachusetts Housing Appeals Committee, Land Court, and Massachusetts Supreme Judicial Court obtaining the grant of a comprehensive permit. The victory in front of the Supreme Judicial Court was featured in a front page article in Massachusetts Lawyers Weekly View Lawyers Weekly Article Successfully obtained Summary Judgment on behalf of Wal Mart and Stanley Access Technologies (a division of Stanley Black & Decker) in Federal Court on products liability and negligence claims. Pritchard v. Stanley Access Technologies, LLC, 2011 WL 309662. Counsel to commercial mortgage-backed securities trust in connection with prosecution of claim against Bank of America seeking repurchase of hundreds of millions of dollars worth of loans. Successfully represented client in a three day jury trial in Suffolk Superior Court, including the award of all attorneys fees, while defeating all counterclaims. Successfully upheld a liquidated damages provision of a contract on the day of trial when the other party was seeking damages in excess of seven times the liquidated damages provision. Successfully defeated motion to dismiss in Delaware Chancery Court arising out of failed merger between two publicly traded companies. Successfully achieved dismissal of wrongful death action in Massachusetts federal court after filing a motion to dismiss for lack of personal jurisdiction. Successfully defended the President and COO of publicly traded corporation in securities class action in Delaware Chancery Court through successful motion to dismiss that was upheld on appeal. Successfully obtained summary judgment on behalf of the developer of high end condominiums in Boston from a claim by a non-original purchaser alleging negligent misrepresentation after allegedly discovering building code violations. Successfully represented developer of proposed 40B project before the Massachusetts Housing Appeals Committee and Land Court obtaining the grant of a comprehensive permit. Successfully obtained summary judgment on behalf of a developer after an abutter appealed variances granted by the Boston Zoning Board of Appeals. Education:George Washington University, 2002 B.
