Robin R. Barnes

In addition to her prosecution and transactional experience, Robin has extensive experience in intellectual property litigation. This experience enables Robin to consider long term consequences to anticipate and avoid potential pitfalls in patent and trademark prosecution and various transactional matters that may result in later litigation. Her litigation experience spans all aspects of intellectual property litigation, from pre-filing investigation through trial in several multimillion-dollar lawsuits involving claims of patent, trademark, and copyright infringement and cybersquatting. She has substantial experience in claim construction analysis and briefing complex patent, copyright and trademark issues at the district court and court of appeals levels. Robin has drafted successful appeals to the Patent Trial and Appeal Board, Markman claim construction briefs, motions for summary judgment of non-infringement, to dismiss for lack of personal jurisdiction, to permit interlocutory appeal on patent-related subject matter jurisdiction, for reconsideration of an unfavorable ruling on a summary judgment motion (briefed by predecessor counsel) in a copyright infringement matter, and dozens of discovery-related motions. Robin has also been the primary draftsperson on four appeals at the Federal Circuit and two appeals at the Fifth Circuit Patent Trial and Appeal Board.
