Emily Stroope

Overview Emily Stroope has a national litigation practice and a broad range of trial and appellate experience in state and federal courts. While Ms. Stroope has represented a wide variety of corporate clients, she focuses her practice on mortgage lending and serving litigation and consumer financial services litigation. Ms. Stroope regularly represents clients against claims of violations of federal and state consumer protection statutes, including violations of the Fair Debt Collection Practices Act (FDCPA), Fair Credit Reporting Act (FCRA), Servicemembers Civil Relief Act (SCRA), and Real Estate Settlement Procedures Act (RESPA). She also handles responses to complaints to the Consumer Finance Protection Bureau (CFPB) for clients in the mortgage industry and has successfully defended national mortgage servicers in court, obtaining awards of dismissal, summary judgment, and take-nothing judgments in their favor. Ms. Stroope has experience defending lenders and other financial services institutions in real estate litigation and contract disputes, and also resolves complex title issues. She manages a large national portfolio of litigation with consistent favorable results in multiple jurisdictions. Ms. Stroope prides herself on exceptional legal writing and trial advocacy. Representative Matters Obtained a favorable opinion from the U. S. Fifth Circuit Court of Appeals affirming final summary judgment from the Texas trial court in favor of a national mortgage servicer and mortgage holder. Obtained a denial of certiorari from the Texas Supreme Court for an appeal in which the opposing party was seeking a change in Texas jurisprudence related to mortgage servicing requirements. Secured a reversal of multiple default judgment awards against corporate clients valued in excess of $500,000. Successfully defended a corporate client in two Texas trials, obtaining take-nothing verdicts. Successfully defended multiple summary judgment awards with various appellate courts across Texas. Led and managed the defense team for a class action case in Ohio. Won summary judgment for a major investment bank in a lawsuit alleging a mortgage was serviced in violation of state and federal law.
