Rusty is a member of Winsteads Business Litigation Practice Group. He is a hard-working and tenacious advocate, litigator, and trial lawyer representing individuals and corporate clients in state and federal courts in an extensive array of contractual and commercial disputes involving real estate, lending, business divorce, and collections matters. He also counsels clients during the pre-litigation phase of disputes in an effort to obtain efficient, favorable outcomes, and avoid unnecessary cost and expense to the client. Representative Experience Represented the seller of a commercial property in a multi-million-dollar lawsuit that included allegations of fraud against the seller, and secured a take-nothing summary judgment in the sellers favor and an award of the sellers attorneys fees. Represented the developer of a residential property in a dispute arising from flooding during Tropical Storm Imelda and secured a take-nothing summary judgment in the developers favor and an award of the developers attorneys fees. Represented a national bank against a borrower in a lawsuit involving allegations fraud and duress and obtained a multimillion-dollar judgment for the bank and an award of attorneys fees. Represented a commercial property owner in a lawsuit arising from a neighboring property owners harassment and threats made to the clients tenants and obtained a favorable judgment following a jury trial. Represented a mortgage lender in a lawsuit arising from the disputed interpretation of the borrowers loan documents and obtained a favorable settlement for the lender.
