He defends oil and gas producers in royalty litigation and commercial disputes and has extensive experience defending against civil antitrust claims. In the financial services sector, Matthew represents national banks, mortgage lenders, and financial institutions in disputes involving various consumer protection and debt collection statutes. Matthew offers to clients a pragmatic approach to problem-solving and an ability to advise on the potential legal effects of business practices. He assists clients in responding to regulatory complaints and advises on business practices and structures. Matthews experience includes advising on royalty payment practices, energy transactions, and drafting agreements and disclosures for consumer finance transactions. Representative Matters Energy Litigation Represents a natural gas production company in multiple lawsuits involving royalty disputes, including serving as a member of the trial team that obtained a total defense verdict in a jury trial of a class action. Represented a natural gas production company in a dispute arising from a commercial transaction. Advised an oil and gas production company concerning royalty payment practices. Advised an oil and gas production company regarding the implications of commercial transactions on lease obligations. Financial Services Litigation Represents a financial consulting firm to obtain the dismissal of claims by enforcing a forum-selection clause. Represented national banks, mortgage lenders, financial services companies, mortgage servicers, and investors in residential mortgage disputes involving alleged FDCPA, TILA, RESPA, FCRA, TDCA, DTPA, and TCPA violations, together with allegations of mortgage fraud, predatory lending, false credit reporting, improper collection, violations of various state and federal statutes, regulations, the home equity provisions of the Texas Constitution, and other lending and servicing errors. Represented a national student loan servicer in various disputes related to student loan servicing, including alleged violations of state consumer protection and debt collection statutes, the FDCPA, and FCRA. Represented financial institutions and financial services companies in adversary proceedings in bankruptcy court. Represented a mortgage lender in administrative proceedings brought by state and federal agencies. Represented lenders, servicers, and an insurance company in disputes arising from hurricane-related property damage. Antitrust Litigation Assists in representing one of the nations largest distributors of dental products and supplies in civil antitrust litigation. Advised a consortium of quick-service and full-service restaurants and food service distributors regarding antitrust compliance. Consumer Protection Litigation Assisted in representing an international software provider in putative class actions alleging violations of multiple consumer protection statutes and related claims. Assisted in representing a national company whose subsidiaries specialize in the purchase and recovery of discharged consumer receivables in a dispute arising under state and federal consumer protection statutes.
