Erik obtained a summary disposition in a no-fault first party action where the plaintiff was driving his vehicle for a ridesharing service at the time of the accident. He successfully argued that the plaintiffs use of the vehicle fit an exclusion within his no-fault policy that prohibited use of the car for carrying passengers for a fee. Plaintiff argued that the car did not actually have passengers at the time of the accident and thus the exclusion was inapplicable. However, Erik asserted that it was irrelevant whether the vehicle had passengers or not, where it was clear the plaintiff was on his way to pick up passengers for a fee. Additionally, Erik has guided numerous wrongful death and minor settlements against insured parties through the Michigan probate system. He also successfully obtained the dismissal of an Ohio personal injury action where the plaintiff had previously asserted a substantially similar claim in Michigan that had been dismissed.
