The court explained that the purpose of the case management conference is to identify the issues in dispute, explore the possibility of settlement or formal mediation, and to set a schedule for discovery and any preliminary motion practice, if any. In this litigation, plaintiff is claiming adverse possession over an undefined portion of defendant's property ("the Disputed Area"). Attorney Millliard explained that his client's adverse possession claim will rely on tacking, since it was originally owned by the plaintiff's ex-husband's family since the early 1970s. He further stated that when the defendant moved into the neighboring property in 2023, disputes arose almost immediately. There have been various complaints between the parties related to trespassing, noise complaints, boundary stakes being moved, chickens crossing the property line, and various other disputes. There have been criminal complaints and restraining orders, neither of which were successful. Upon inquiry from the court, Attorney Millliard clarified that the Disputed Area that plaintiff claims is a portion of Lot 6, as identified in a survey appended as the last exhibit to the defendant's counterclaim. He didn't know exact boundaries of the Disputed Area but believes a significant portion of it is comprised of wetlands. He stated that his clients use of the Disputed Area has included lawn care, gardening, allowing chickens to feed, and similar activities to the extent they were permitted under the Wetlands Protection Act. In spite of the tension between the parties, Attorney Milliard stated that his client may be amenable to mediation through REBA or similar ADR organization, especially if more cost-effective than litigation. Attorney Wilker stated that she is still assessing the case, as she just entered her appearance before the hearing, but based on the information she has, there are questions as to whether plaintiff's use of the Disputed Area was hostile or permissive, and that she has reason to believe permission was granted. Attorney Wilker also reported that her client may be amenable to mediation, but that more information was needed to define the Disputed Area the plaintiff is claiming. After discussion, the court ORDERED the parties to confer and submit a joint status report on or before December 30, 2025, stating whether their clients will agree to participate in formal mediation. The court further ADOPTED the parties' proposed discovery schedule and ORDERED fact discovery to be complete no later than May 18, 2026, and expert depositions to be complete by July 31, 2026. If the parties report on December 30, 2025, that they wish to participate in mediation, the court will stay discovery while mediation is pursued. The parties are further ORDERED to appear for a status conference on August 4, 2026, at 10:00 AM, via videoconference.
