Mr. Nelson has filed suit against the Defendant, Wells Fargo, in which he alleges that it does not have the legal authority to conduct the mortgage foreclosure sale scheduled for today at 10:00 AM. The property in question is 65 Lovers Lane in Groton. Before the court is the Plaintiff's Motion for Temporary Restraining Order to stop the scheduled foreclosure sale and the Defendant's Opposition. Notwithstanding the failure of Mr. Nelson to appear for the hearing that he requested, the court allowed counsel for Wells Fargo the opportunity to argue in opposition to Mr. Nelson's motion for the TRO. Counsel indicated that there are procedural failures in Mr. Nelson's attempt to stop the foreclosure including a failure of service on the Defendant. Counsel became aware of Mr. Nelson's complaint and this hearing through a litigation monitoring service to which his law firm subscribes. On the merits, counsel argued that there is no factual or legal basis for the court to grant the relief requested by Mr. Nelson. He recounted a history of litigation in multiple courts beginning in 2012, through which Mr. Nelson sought to stop or frustrate the Defendant's efforts to complete the mortgage foreclosure. The exhibits attached to the Defendant's Opposition reflect the docket sheets and other germane court rulings from these several actions. Following argument, the court DENIED the Plaintiff's Emergency Motion for Temporary Restraining Order for the reasons set forth in the Defendant's Opposition and as put forth on the record in open court. (Smith, J.).
