Appellant's response acknowledged the notice of appeal to be untimely filed, but requested leniency and attributed the untimely filing to hospitalization for an emergency medical procedure. Section 288.210 simply does not allow for the late filing of a notice of appeal, regardless of reason; without a timely notice of appeal, this Court lacks jurisdiction. Ruiz v. DOTec Corp., 651 S.W.3d 227, 229 (Mo. App. E.D. 2022). Although Rule 81.07(a) typically allows this Court discretion to issue a special order allowing untimely appeal where a delay is ?not due to appellant's culpable negligence,? Section 288.210 prevents this Rule from applying to appeals from unemployment matters. Id. at 229-30 (internal citations omitted). Simply put, this Court lacks the authority to grant leniency to consider the merits of this appeal. On the court's own motion, the appeal is dismissed for lack of jurisdiction.

Under Section 288.210, RSMo, the notice of appeal was due within twenty (20) days after the decision of the Commission appealed from became final. The decision of the Commission became final ten (10) days after the date of mailing of the decision to the parties. Section 288.200.2, RSMo. Here, the Secretary of the Commission mailed its decision to the parties on August 26, 2025. The decision became final ten days later on September 5, 2023, and Appellant's notice of appeal was due twenty days thereafter (except where the final day falls on a Saturday, Sunday or legal holiday), in this case, Thursday September 25, 2025.
