- Order (Judicial Officer: McLean, Evelyn) Comment (IT IS THEREFORE ORDERED that in accordance with Section 822.042(a)-(e) of the Texas Health & Safety Code, and before the 31st day after the date of this hearing, the owner, Sasha Baker aka Sasha Barker, shall: (1) Register the dangerous dog with the animal control authority for the area in which the dog is kept; (2) Restrain the dangerous dog at all times on a leash in the immediate control of a person or in a secure enclosure clearly marked as containing a dangerous dog; and (3) Obtain liability insurance coverage or show financial responsibility in an amount of at least $100,000 to cover damages resulting form an attack by the dangerous dog causing bodily injury to a person and provide proof of the required liability insurance coverage or financial responsibility to the animal control authority for the area in which the dog is kept. IT IS FURTHER ORDERED that in accordance with Williamson County Ordinance, Texas Regulations for the Control of Rabies and Animal Control, the owner, Sasha Baker aka Sasha Barker, shall: (1) Notify Williamson County Animal Control as soon as possible, but under any circumstances within 24 hours upon notification or learning, that the dangerous dog is loose, stolen, or unconfined; has attacked another animal or a person; or has died; (2) Receive written approval from a Williamson County Animal Control Officer if the dangerous dog is to be given away, sold, or relocated; (3) If written approval is received for the dangerous dog to be given away, sold, or relocated, the owner shall provide the regulatory officer with the name, address, and telephone number of the new owner and location of the new or improved enclosure. The new owner must sign a sworn statement that they will comply with all the requirements of owners of dangerous animals if the new owner resides within Williamson County. The new owner must comply with the requirements of keeping an animal with the designation of dangerous animal within 30 days; (4) Keep the dangerous dog in a proper enclosure. The fence or structure/pen must form a secure enclosure with sides suitable to prevent entry of young children and must be locked and secured at all times to ensure that the dog cannot climb, dig, jump, or otherwise escape of its own volition. The structure/pen shall provide protection from the elements for the animal; (5) Present to the Williamson County Animal Control Office a certificate of public liability insurance in the amount of $100,000.00 to cover any damages caused or which may be caused by the dangerous dog. The insurance shall be for a 12-month period and shall not be cancelled unless the animal is no longer kept by the owner; (6) Securely muzzle the dangerous dog in a manner that will not cause injury to the dangerous dog or interfere with its vision or respiration when the dangerous dog is taken outside of the enclosure. The dangerous dog must be restrained by a substantial chain or cable leash having a minimum tensile strength of 1,000 pounds and not to exceed 6 feet in length. The dangerous animal shall be restricted from any public park; (7) Affix signs having reflective letters and backing with letters measuring at least 1.5 inches in width and 1.5 inches in height and reading "Beware of Dangerous Dog." Signage must be posted in a conspicuous place at all entrances to the premises on or within which such dog is kept; (8) Attend and complete a training class and/or behavior modification course with the dangerous dog. The class must be designed to teach the owner how to deal with, correct, manage, and/or alter a behavioral problem. Additionally, the course must be approved by Williamson County Animal Control; (9) Provide proof to the Williamson County Animal Control that the dangerous dog has been spayed or neutered within 10 days from the date of this hearing. IT IS FURTHER ORDERED that should the owner, Sasha Baker aka Sasha Barker, fail to comply with the aforementioned Order before the 31st day after the date on which the dog was seized, the animal control authority shall humanely destroy the said dog pursuant to Section 822.042(e) of the Texas Health & Safety Code. IT IS FURTHER ORDERED that pursuant to Section 822.042(d), the owner, Sasha Baker aka Sasha Barker, shall pay all costs and fees assessed by the county related to the seizure, acceptance, or destruction of said dog to the Williamson County Animal Shelter totaling $230.00 as of the date of this order, and any fees incurred thereafter.)
