- he Court has received two items from the Narayanas. The first is Mr. Narayana's partial response to Ms. Mimms's interrogatories. Rule 5(d)(2) of the Massachusetts Rules of Civil Procedure states than unless the court orders otherwise, a party shall not present for filing, and the court shall not accept for filing, a party's answers to interrogatories unless that party is "pressing or opposing any motion or other application for relief" and the answers are pertinent to that motion. Diverting water onto another's property, by itself, is what Massachusetts law calls a "nuisance." See, for example, DeSanctis v. Lynn Water & Sewer Comm'n, 423 Mass. 112, 116 (1996).
