Evidence is adduced on plaintiff's petition and defendant's counterclaim. Plaintiff seeks back rent in the amount of $1,175 per month for August, September, October, November and December 2024 totaling rent due in the amount of $5,875, or in the alternative one-half rent for August 2024. Plaintiff also seeks $1,480 in late payment fees for August through December. Plaintiff is not seeking attorneys' fees. Defendants/counterclaim plaintiffs seek a reimbursement of rent in the amount of $1,175 for the month of July 2024, and a waiver of rent for the months of August, September, October, November and December 2024, and a waiver of late fees for August through December. In addition, defendants/counterclaim plaintiffs seek attorneys' fees. In the alternative, defendant seeks a waiver of late fees for November and December 2024 when the lower court had the case under advisement. The Court finds in favor of defendants/counterclaim plaintiffs and finds that rent in the amount of $1,175 for July 2024 should be refunded; that rent for August 2024 through December 2024 should be waived; and finds that late fees from August 2024 through December 2024 should be waived. The Court denies defendants' motion for attorneys' fees. The parties are advised of the right to an appeal. By COB on Monday, March 17, 2025, and without waiver of objections, defendants shall email the Court with copy to opposing counsel a proposed judgment in Word document form in accordance w/ the Court's findings.
