- Filed Order Denying Motion. Appellant has filed a second amended motion asking this court to direct the district court to transmit State's Exhibit 459 and Defense Exhibits A-E to this court. Appellant first filed a procedurally compliant version of this motion on July 21, 2025. This court granted the motion as to State's Exhibit 459, but denied the motion as to the defense exhibits. This court explained that appellant did not demonstrate that the defense exhibits are incapable of inclusion in the appendix as required. Appellant then filed an amended motion requesting transmission of the defense exhibits. Appellant asserted that the exhibits were confidential and too voluminous to be filed in the appendix. This court denied the motion because appellant did not demonstrate the exhibits could not be included in the appendix. This court again advised appellant that if he believes that the exhibits should be filed under seal in this court, he should file a motion in accordance with Howard v. State, along with any appendix containing the documents. The motion is denied as moot with respect to State's Exhibit 459. - Filed Order Denying Motion. Appellant has filed a third amended motion asking this court to direct the district court to transmit certain exhibits to this court. Appellant still does not demonstrate that transmission of the defense exhibits from the district court is warranted. As repeatedly explained, to warrant transmission of original documents from the clerk of the district court to this court, a movant must demonstrate that the exhibits are incapable of inclusion in the appendix or that review of the original exhibits is necessary for determination of the issues on appeal. NRAP 30(d). Appellant does not even allege that these circumstances exist with respect to the exhibits. Counsel for appellant, Betsy Allen, is admonished for her repeated filing of unsupported and unwarranted motions to transmit exhibits. Although the current motion does not request such relief, it appears Ms. Allen is attempting to seek leave to file the documents attached to the motion in a sealed, supplemental appendix. The documents may be appropriate for filing under seal. But this court is unable to file them at this time because they do not bear the file-stamp of the district court clerk as required. The clerk shall detach the documents from the motion filed on September 11, 2025, and return them unfiled. Ms. Allen shall have 14 days from the date of this order to file and serve any motion for leave to file a supplemental appendix under seal. Along with the motion, Ms. Allen should provide this court, via mail, with a proposed supplemental appendix, along with supplemental indexes, containing the documents she seeks to file under seal.
