- Order of Dismissal Movant was convinced of murder in the first degree in Cause NO. 22031-00035 in March 25, 2004. He was thereafter sentenced to life imprisonment without probation or parole. Movant sppealed his conviction, and the Court of Appeals affirmed Movant's conviction on April 19, 2005. State v. Bell, 161 S.W.3d 889 (Mo.App E.D. 2005) The mandate was issued on May 26, 2005. Movant timely filed a motion pursuant to Rule 29.15 in Cause No.2205P-04665. The Court denied Movant's Rule 29.15 motion following and evidentiary hearing on October 12, 2006. The denial of Movant's motion was affirmed on appeal on November 20, 2007. Bell v. State, 240 S.W.3d 738 (Mo.App. E.D. 2007). In 2009, Movant filed a motion to reopen his Rule 29.15 proceeding, which the COurt denied on September 9, 2009. In 2016 Movant filed another motion to reopen his Rule 29.15 oriceeding which in Court denied on May 24, 2016. On February 14, 2022, Movant filed a motion to recall the mandate in his original post-conviction appeal, which the Court of Appeals denied on March 2, 2022. Rule 29.15 (b) provides, "Failure to file a motion within the time provided by this Rule 29.15 shall constitute a complete waiver of any right to proceed under this Rule 29.15 and a complete waiver of any claims that could be raised in a motion filed pursuant to this Rule 29.15." Rule 29.15 (1) further provides, "The circuit court shall not entertain successive motions." The Court finds that this motion is out of time and is a prohibited successive motion. THEREFORE, the Court orders, adjudges and decrees that the Motion made pursuant to Supreme COurt Rule 29.15 in this cause is DISMISSED. (see memo) SO ORDERED: JUDGE JOSEPH P. WHYTE #38194
