The Court makes the following findings and judgments in this cause: All jurisdictional issues have been met. There remains no reasonable likelihood that the marriage of the parties can be preserved and, therefore, the marriage is irretrievably broken and ordered dissolved. No maintenance is to be paid by either party for the support of the other. They each waive the right to return to Court to request and receive maintenance, this provision being forever non-modifiable. Respondent is not now pregnant. Neither party is on active duty in the armed forces. Three children were born or adopted into the marriage with two surviving. The Court approves the Petitioner's Parenting Plan (marked as Exhibit B) as reasonable and being in the best interest of the minor children. Petitioner and Respondent are awarded Joint Legal Custody and Joint Physical Custody, with the children's primary residence being with the Petitioner. Petitioner's address is designated as the childrens' address for mailing and educational purposes. The parties calculated the presumed child support amount as set forth in the Form 14 (marked as Exhibit C) to be paid by the Respondent to Petitioner is $1,056.00 a month, beginning February 2, 2024. Marital property shall be divided according to Petitioner's Statement of Property (marked as Exhibit A.) Respondent is awarded the real property located in Putnam County (Exhibit 1.) The Petitioner will effectuate releases of title/quit claim deed to the real estate in Putnam County. Court costs are to be paid by the Petitioner from the deposit previously paid to the Court.
