- The email I received on 12/11 was about court conduct, not eliciting a response from the Cracchiolos. Any response from them could lead to Attorney DiCarlo drafting a 35-page filing, overly referencing "Mr. Bass" without legal precedents or support for the court's actions. I don't have the time or inclination to sift through another fictional narrative by the Cracchiolos' attorneys. Our responses, if any, should be akin to what a seasoned lawyer would write, not an 8th grader. They should include legal references about issues like bifurcated settlement terms absent in rulings, maintaining a Lis Pendens after dismissal of related claims, or breach of contract allegations during pending court motions. I am exasperated by arguments that essentially say, "Mr. Bass is an a**hole, so legal norms can be disregarded." I am tired of such baseless arguments being accepted. In my 18 months of studying law, I've learned to craft legitimate legal arguments. I expect the same from BAR members. However, Attorneys Heney and DiCarlo's use of past communications for allegations in 2020-21 goes against this principle. Law school teaches the application of law based on principles and precedents, not creating a narrative from email chains. This approach should be grounds for sanctions, not success. "Does Judge Foster realize that if the attorneys believe they can receive a favorable discretionary decision from him, it puts me at a significant disadvantage during any discussions about resolving the cases related to the house? The advantage is insurmountable, making it impossible for me to compete." -BB
