The Department of Revenue does not appear, however, the Court takes judicial notice of the formal answer filed by D.O.R. and the certified driving record of the Petitioner. On the record: Court confirms that an expungement has occurred and Petitioner is eligible for a hearing on reinstatement of his license. Petitioner is sworn and testifies. Pursuant to 302.060(9) RSMo, this Court finds that Petitioner has not been found guilty of, and has no pending charges for any offense related to alcohol, controlled substances or drugs and has no other alcohol-related enforcement contacts as defined in section 302.525 during the preceding ten years and that the petitioner¿s habits and conduct show that petitioner no longer poses a threat to the public safety of this state. Therefore, the court orders the director of revenue to issue a license to the petitioner if the petitioner is otherwise qualified pursuant to the provisions of sections 302.010 to 302.540. Petitioner is ordered to install ignition interlock device in motor vehicle and maintain said device for 6 months following the date of the order in this case.
