Judgment Entered Now on this 5 th day of July, 2023, this cause coming on for trial, come the Plaintiffs in person and by attorney, but the Defendants, though duly notified and served by publication as required by law, have failed to respond to the Plaintiffs Petition and though being duly called, come not; and this cause being taken up and heard and submitted to the Court upon the pleadings and the evidence, the Court, being fully advised in the premises, finds the issues for the Plaintiff and finds, adjudges and decrees that the Plaintiff is vested with fee simple title to the real estate described in the petition, to-wit: A part of the West half of the West half of the East half of the Northeast quarter of the Southeast quarter and part of the East half of the West half of the East half of the Northeast quarter of the Southeast quarter of Section Thirty-four (34), Township Forty (40) North, Range Four (4) East, described as follows: Beginning at a point in the center line of the County Road, known as Clark Street, said point being the intersection of the center line of said County Road with the East line of a tract conveyed by C.F. Seemel and wife to Charles A. Gordon and wife, by deed dated March 22, 1943, in Book 153 Page 324 of the Jefferson County Land Records, and running thence North along the East line of said tract 105 feet to a point; thence West 76 feet to a point; thence South 2 degrees 15 minutes East 105.07 feet to a point in the center line of said Clark Street; thence East along the center line of Clark Street '71.88 feet to the place of beginning. Subject to easements, restrictions, reservations and covenants of record, if any. and the Court further finds, adjudges and decrees that the Defendants have no right, claim, estate, interest or title in or to said real estate, that any deed of trust has been heretofore been satisfied and the Defendants have no interest pursuant to a deed of trust or otherwise by lien upon such real property, and it is further adjudged that the costs of this proceeding are assessed against Plaintiff.
