L. c. 32, § 5 (2) (a), 2nd sentence, which alters a public employee's retirement allowance "if, in the 5 years of creditable service immediately preceding retirement, the difference in the annual rate of regular compensation between any 2 consecutive years exceeds 100 percent," applies where a public employee leaves public employment and returns some years later at a higher salary, such that the employee's salary increased by more than 100 percent between two of the last five years of creditable service, but where those years are not two consecutive calendar years; and whether the anti-spiking provision applies where the public employee returned to public service at the increased salary before the anti-spiking provision was enacted.
