The defendant has already received a notice preceding dismissal for want of prosecution. On September 5, 2023, the defendant received an enlargement to January 23, 2024, noting that "[n]o further enlargement should be anticipated." On January 12, 2024, the defendant moved for an enlargement to February 16, 2024. This motion was denied "without prejudice to renewal with brief and appendix on or before 2/16/24." Even though the enlargement to February 16, 2024, was denied, the defendant now moves for an enlargement to April 5, 2024, for substantially the same reasons that were inadequate in January. This case, in which there were only five witnesses over two days of testimony, does not require anything close to 298 days to brief.
