- Hearing Journal Entry This matter comes before the Court for Disposition. State appears by Deputy Prosecutor Jacqueline Hensley. Defendant appears in person, and by counsel, Grey Harris. The Court is advised that the State and defendant have entered into a written Plea Agreement and the defendant desires to withdraw his not guilty plea and enter a plea of guilty as to Count I: Possession of Methamphetamine, Level 6 Felony; and Count II: Possession of Paraphernalia, Class C Misdemeanor. The State presents a summary of the evidence it would present if a trial were had in this cause. Defendant confirms the accuracy of the State's summary. The Court finds that the defendant is guilty of Count I and Count II and has freely and knowingly made a waiver of his constitutional rights. The Court now permits the previously entered not guilty plea to be withdrawn and accepts the defendant's guilty plea. The Court finds the defendant guilty of Count I: Possession of Methamphetamine, Level 6 Felony; and Count II: Possession of Paraphernalia, Class C Misdemeanor. The State presents a summary of the evidence it would present if a trial were had in this cause. Defendant waives his right to presentence investigation and requests sentencing at this time. The State having no objection, the Court proceeds to sentencing. Defendant examined as to the written Plea Agreement and his constitutional rights. Written Plea Agreement approved. Evidence and argument heard as to sentencing. The Court now imposes the following sentence in accordance therewith: For Count I: Possession of Methamphetamine, Level 6 Felony, sentenced to the Madison County Jail for a period of one hundred eighty (180) days; For Count II: Possession of Paraphernalia, Class C Misdemeanor, sentenced to the Madison County Jail for a period of twenty (20) days. Sentence imposed shall run concurrently for a total sentence of one hundred eighty (180) days. One hundred eighty (180) days ordered executed at the Madison County Jail/MCCC. Credit time (plus good time) from and after 6-27-22. Defendant acknowledges accuracy of credit time. Sentence imposed shall run consecutively to his case in Hamilton County. Defendant ordered to obtain a substance abuse evaluation while at the Madison County Jail, comply with all treatment recommendations, and provide written verification of compliance to the Probation Department. Attorney Harris' appointment as Public Defender is now vacated. Costs vs. defendant. Bond, if any, ordered released upon payment of costs. Clerk is directed to withhold from the cash bond submitted herein the following fees: Cash Bond Administrative Fee; $100 Public Defender Fee; $200 Drug Abuse Fee; and $185 Court Cost. JUDGMENT.
