- JE- On July 1, 2024 this matter came on for hearing to address outstanding claims against the estate. Terrea Stanton, Administrator of the Estate along with her sister Karen Schmid. Attorneys Evans and Pome appeared telephonically on July 1, 2024. This hearing was re-scheduled due to Administrator's medical emergency for which she provided satisfactory proof to the Court. Despite being ordered to do so, Administrator did not file receipts reflecting the distribution of insurance proceeds. However, both acknowledged that they each received $2,500.00 from Bankers Fidelity Life Insurance Company. Attorney Evans advised the Court that the insurance proceeds are assets of the estate because the Administrator and her sister were not Co-Beneficiaries of the policy. Administrator and sister advised the Court that they are both receiving Social Security Disability payments and do not have the proceeds. Administrator owns real estate with equity. The Court notes that Form 1.0 failed to list her brother. Therefore, Administrator Terrea Stanton SHALL make immediate arrangements to account for estate assets in the sum of $5,000.00 and keep Attorney Evans apprised of her efforts. Should Terrea Stanton believe that she is entitled to reimbursement for funeral expenses she should immediately share proof with Attorneys Evans and Pomy. The Court FINDS that the Interim Claim for the amount of $4,712.50 is HEREBY APPROVED. The balance remaining SHALL be paid to claim filed by Weltman, Weinberg & Reis Co. on behalf of Discover Bank. However there may be reimbursement due and owing for funeral expenses of decedent which will reduce the amount of claims. Terrea Stanton, Attorney Evans or Attorney Pomy may file a written request for a hearing if this matter cannot be resolved or give notice of an agreement leading to the conclusion of the estate proceedings. Lastly, the Clerk shall assign a final Pre-Trial Hearing if no filings are presented on or before August 16, 2024.
