- Hearing Journal Entry This matter comes before the Court for sentencing. State appears by Deputy Prosecutor Cathy Wilson. Defendant appears in person from the Madison County Jail and by counsel, Bryan Williams. Defendant sworn and examined as to the Presentence Investigation, written plea, and her constitutional rights. The Court finds aggravation: 1) criminal history; 2) multiple counts; 3) multiple victims. The Court finds mitigation: 1) defendant pled guilty to the instant offense, saving the State the time and cost of trial. Court takes judicial notice of its file, and the Presentence Investigation report. Court accepts the defendant's plea of guilt and the plea agreement. The Court now imposes the following sentence in accordance therewith: For Count I: Child Solicitation, Level F Felony, sentenced to four (4) years Department of Corrections; For Count II: Sexual Battery, Level 6 Felony, Level six (6) felony, sentenced to twenty (20) months at the Madison County Detention Center; For Count III:, Contributing to the Delinquency of a Minor, Level six (6) felony, sentenced to twenty (20) months at the Madison County Detention Center; For Count IV: Contributing to the Delinquency of a Minor, Level six (6) felony, sentenced to twenty (20) months at the Madison County Detention Center; For Count V: Contributing to the Delinquency of a Minor, Level six (6) felony, sentenced to twenty (20) months at the Madison County Detention Center; Sentence imposed shall run concurrently for a total sentence of four (4) years. Three (3) to be executed at the Department of Corrections. One (1) year suspended to Probation. Credit time (plus good time) of 12-21-21 to 12-29-21 and 2-2-22 to 9-16-22. Defendant acknowledges accuracy of credit time. Defendant placed on probation for a period of one (1) year. Standard conditions of probation, including monthly reporting and keeping the Probation Department informed of a current address, shall be reduced to writing, explained to the defendant, and an executed copy filed with the Court. Included among the special terms of probation are: .Defendant ordered to obtain a substance abuse evaluation at a treatment facility approved by the Probation Department, comply with all treatment recommendations, and provide written verification of compliance to the Probation Department; .Defendant ordered to totally abstain from the use of alcoholic beverages and/or illicit drugs. On three (3) hours notice from the Probation Department, defendant ordered to submit to random urine and/or chemical screens, and be financially responsible for said tests; .Submit to DNA analysis as arranged by the Probation Department; .Defendant ordered to find and maintain employment of 35 hours or more per week. Defendant shall provide written verification of compliance to the Probation Department; if unemployed, successfully participate in job seeking skills program approved by Probation Department; .Defendant ordered to have no contact with the victim(s) E.M., T.M., and N.W. .Defendant not to have contact with victims K.C. and S.C. until there is a Court Order or have completed Sex Abuse Treatment. .Probation User's Fees assessed against the Defendant as follows: An initial fee of $90.00 due within thirty (30) days and $30.00 per month thereafter; .Administrative Fee of $100.00 assessed against Defendant; .Court costs of $185.00 assessed against Defendant; Executed copy of Probation Order issued. ks Judicial Officer: Dudley, Mark Hearing Date: 09/16/2022
