  88. Hearing Journal Entry This matter comes before the Court for sentencing hearing. State appears by Deputy Prosecutor, Justine Szostak, in person. Defendant appears in the custody of the Madison County Sheriff and by counsel, Jimmy McDole, in person. Defendant is sworn & examined as to the Pre-Sentence Investigation Report. Plea of guilty and plea agreement accepted, judgment and conviction entered. Sentencing hearing held. For Count I: Carrying a Handgun Without a License, Prior Felony Conviction, a Level 5 Felony, the Defendant is sentenced to Indiana Department of Corrections for a period of 5 years. For Count II: Theft of a Firearm, a Level 6 Felony, the Defendant is sentenced to Indiana Department of Corrections for a period of 2 years. For Count III: Possession of Marijuana, a Class B Misdemeanor, the Defendant is sentenced to Madison County Detention Center for a period of 180 days. All counts to run concurrently for a total sentence of 5 years. Credit for 3 accrued days (MCJ: 12/12/21-12/14/21) plus earned credit of 1 day. Defendant and Counsel acknowledge the accuracy of the accrued credit time as reported in open court. 2.5 years, less credit time, are ordered served at the Department of Corrections. The remaining 2.5 years are suspended to formal probation. This case is ordered to run consecutively to 48C01-2002-F6-438. Abstract of Judgment issued. Probation for 2.5 years with terms and conditions as set out in written sentencing and probation orders. Fees and costs assessed against the Defendant: court costs $185; $10 fine; $200 school safety fee; $100 administrative fee; and $90 probation user fee. Bond is ordered released upon payment of costs and fees. Defendant is ordered to report to Probation within 48 hours of release from incarceration. Further, Defendant requests to participate in purposeful incarceration.
