- rder March 24, 2022 Court examines the two Affidavits to Establish Title of Distributee(s) to Property in Estate of Less than $40,000. Although the Affidavits were previously not signed and/or notarized as required by Sections 473.050 and 473.097 of the Revised Statutes of the State of Missouri, these requirements are now satisfied. After such examination, the Court finds that Decedent was a resident of Mercer County at the time of his death and more than 30 days have passed since the date of his death. A Missouri Healthnet Waiver is not on file, but an Estate Notice from the Missouri Department of Social Services - MO Healthnet Division, is on file, and such notice states that a Healthnet Waiver was issued on 11/9/2021. Proof is on file that the funeral bill for Decedent has been paid in full. No application for letters testamentary has been granted by this court or of administration and no application for refusal of letters under section 473.090, R.S.Mo. is pending or has been granted. Proof of Publication is not yet on file showing notice to creditors of the decedent to file their claims in the court or be forever barred in accordance with section 473.090.5, R.S.Mo. Therefore, notice is to be published once a week for two consecutive weeks as required. Once proof of publication is filed, the Clerk is directed to issue Certificate of Clerk in accordance with Section 473.097 R.S.Mo. Bond was waived by separate order. IT IS SO ORDERED. MMK

- rder February 25, 2022 The Court is in receipt of Sandra Logemann's letter to the court dated 2/18/22. There are some issues with what has been filed with the court. The Court duly notes that applicant is a self-represented litigant. The Court will address what the issues are so Applicant/Affiant can correct and address them so the estate can move forward as requested by Ms. Logemann. The Court examines the two Affidavits to Establish Title of Distributee to Property in Estate of Less than $40,000. One Affidavit is not signed or notarized, and both are required by Sections 473.050 and 473.097 of the Revised Statutes of the State of Missouri. The second Affidavit is signed by the Affiant but her signature is not notarized as required. Therefore, such form does not constitute an "affidavit" as required by Missouri law. Both Affidavit forms do in fact have notary signature blocks following the signature lines. Before the Court can process the Affidavits, at least one of them will need to be notarized as required by Missouri law as previously noted. The Court directs the Probate Clerk to mail both Affidavits back to Ms. Logemann so she can correct these issues. Going forward, it would also be helpful to the court if Affiant could file a document from the funeral home indicating that the funeral services were paid in full. The document filed with the court indicates a payment was made, but nothing about being paid in full or that there is a zero balance. Once these requirements are satisfied, the court should be able to move this estate matter forward and in accordance with Chapter 473. SO ORDERED. MMK
