By way of history of the last few weeks, cases involving these children have been pending in the Juvenile Division of the Court System for a little more than one year. Mother has been in and out of treatment. Mother's whereabouts were unknown for a significant period of time. At the time of the filing of the Petitions, and ultimately, she was served by Publication. However, the Court received a letter from the Mother, and the docket will reflect that. In any event, she is aware of the guardianship Petition. She does not agree with the guardianship, but she could not be here today because of the Covid infection. Further, Mr. Chidister has been involved in an e-mail chain with Mr. Justin Gregory, the attorney for the Mother in the juvenile cases. Mr. Gregory does not represent the Mother in these guardianship cases. Mr. Gregory has taken it upon himself to inform the Court that the mother has Covid and can't be here today. He requested on her behalf, without entering his appearance, a continuance. The Court has denied that request for continuance as the children do not have a legal guardian or custodian. The Court will hear evidence today in order to serve the best interests and needs of the children. However, I do grant him twenty (20) days to file, on behalf of the mother, a response to the guardianships. Technically, the Mother is in default. However, if she retains an attorney, then she will be given a chance to file a formal response and present evidence. The Court has granted her twenty (20) days to do so. Mr. Lee Atwill is here as Guardian ad Litem on behalf of the children. He is aware of the circumstances herein outlined. Mr. Atwill recommends that we proceed today to protect the children.
