  23. Hearing by Zoom on Rosenzweig's motion for def's immediate release from custody. He, Jacob Holmes, Chris Brown, the defendant and I all appeared by Zoom. CCR Wright reported the hearing. Exhibits tendered by Brown prior to the hearing via email rec'd into evidence by agreement. Confusion has arisen regarding the number of misdemeanors dealt with in a close period of time. Two appeals have been filed, and uncertainty exists regarding bonds that may have been posted. Holmes is to supplement any information he is able to obtain regarding bonds posted, and the hearing will resume tomorrow for consideration of that information. In the interim, pursuant to Ark. R. Crim. P. Rule 36(d), this Court concludes that it has acquired jurisdiction based upon the filing of the initial affidavit. Further, upon motion of the defendant, the clerk of district court is ordered to prepare, certify, and file a record in the circuit court, also pursuant to rule 36(d). All remaining issues including Rosenzweig's request for def to be released are reserved until tomorrow morning's Zoom hearing. 11:00. CGT

  38. Zoom hearing at 11:00 today in this case and in companion case 20-60. Appearances: defendant, atty J. Rosenzweig, former atty Jake Holmes, DPA Chris Brown, CCR Sandra Wright and myself. Hearing was continued from yesterday to allow attorneys additional time to submit documents regarding def's bond. Additional documentation rec'd as exhibit today w/o obj. In this case, the defendant waived FA and entered plea of NG. (As such, def's P/A date of 3/29 is no longer necessary. DPA Brown asked to notify Sarah Kelley-Ramsey so this case will not appear on the docket for that date). This case and the companion case are to be transferred to Division 5. Division 5 already has several other cases involving this defendant. All pending cases will be set for Division 5's upcoming chambers day and trial term. Defendant is advised of those dates and is informed of consequences of FTA. In this case, defendant's motion for immediate release is granted. In the companion case, def was required to post a $5K cash only bond. In this case, he has posted a $2500 bond on the charge of viol of no contact order - totaling $7500 between the two cases. To require an additional cash only bond of $15,300 overlooks the fact that the def has already posted $2500 in 21-5104, and is the equivalent of 10% of a $153,000 C/S bond. The court finds this amount to unreasonable given the misdemeanor nature of the charges, that the amount is punitive in nature, and that it has the effect of hindering his right to appeal. Defendant's appearance bond in this case will be the same as what the defendant has posted in both cases involving misdemeanor criminal appeals (this case and 22-60) pursuant to Ark. R. Crim. P. 36. Conditions include that def remains under no contact orders stemming from these cases in addition to other conditions stated on the record. Yesterday, upon defense motion, the court approved an order requiring the district clerk to prepare and tender the transcript for the cases appealed within this case number also pursuant to Rule 36. Rosenzeig to submit orders from today's hearing. CGT
