Following opening statements and some evidence, it was discovered that the alternate, who was supposed to be Mr. Griffith, was not present and Mr. Koch was sitting as alternate. Plaintiff did not agree to allow Mr. Koch to continue to sit so Mr. Koch was released. Court heard testimony and received evidence on April 2 and April 3. Court held charge conference on the morning of 4/4. Parties stipulated regarding salvage, deductible, date all documents requested provided and that the claim was not paid within 75 days of that date. Jury came in and both parties rested and closed. Jury out at 10:52 and back at 12:30. 11/1 verdict. No breach found. This was the only question answered. Defense will prepare judgment.
