The Court makes the following findings and judgments in this cause: All jurisdictional issues have been met. There remains no reasonable likelihood that the marriage of the parties can be preserved and, therefore, the marriage is irretrievably broken and ordered dissolved. No maintenance is to be paid by either party for the support of the other. They each waive the right to return to Court to request and receive maintenance, this provision being forever non-modifiable. Respondent is not now pregnant. Neither party is on active duty in the armed forces. Two children were born during the marriage, S.P.W. and C.B. Petitioner testifies that he is the father of S.P.W. but not the father of C.B. Petitioner introduces Determination of Paternity Lab Results (marked as Exhibit F) that shows he is not the father of C.B. Respondent testifies that Petitioner is not the father of C.B. and that the father, Joshua Brown, is present in the courtroom and listed on the child's birth certificate. Joshua Brown testifies that he is C.B.'s father. The Court finds that Petitioner is NOT the father of C.B. The Court approves the Petitioner's Parenting Plan (marked as Exhibit B) as reasonable and being in the best interest of minor child, S.P.W. Parties shall have Joint Legal and Joint Physical Custody, due to Petitioner's testimony that the Respondent's circumstances have changed since he filed the case asking for Sole Legal Custody. S.P.W. will remain and live with Petitioner as the primary care giver with Respondent allowed reasonable visitation pursuant to the Joint Parenting Plan. Petitioner's address is designated as the child's address for mailing and educational purposes. Petitioner is allowed to claim S.P.W. as a dependent on his federal and state income taxes. The presumed child support amount as set forth in the Form 14 (marked as Exhibit E) to be paid by the Respondent to Petitioner is $369.00 a month, said amount is rebutted and determined to be unjust and inappropriate as neither party is requesting child support. Marital property shall be divided according to Petitioner's Statement of Property (marked as Exhibit C.) There is no real property to divide. Petitioner testified that all marital property has been divided as the parties have been separated for over two years. The parties will effectuate releases of title concerning vehicles. Wife's name is restored to Megan Jean Maletta. Court costs are to be paid by the Petitioner from the deposit previously paid to the Court. Neither party is awarded attorney's fees.
