Court held hearing and by agreement amongst the parties Mr. Olivares depo will occur 1/10/23 and the corporate rep will be 1/11/23. The Court did not rule on the motion to compel as the parties presented issues that were beyond their control. Specifically, there were issues with the service provider completing service to D despite the system showing delivery. The Court will also note that there were legitimate reasons counsel Bain was not available at the earlier dates or responsive during the summer and fall. Finally, Mr. Asafi did state he incurred a $500 cancellation of depo fee; the court is not currently awarding this fee recover to Mr. Asafi but will note that if there are discovery issues in the future he is welcome to raise the issue again.
