Benjamin S. Ben handles personal injury and wrongful death claims, including cases involving dangerous products (product liability); workplace accidents; tractor-trailer and other large truck crashes; auto crashes; motorcycle crashes; slips, trips, and falls (premises liability); dangerous roadway accidents; construction accidents, farming accidents, boating accidents, medical malpractice; and workers compensation cases. Ben has helped his clients obtain over $80 million in settlements and verdicts. Since 2020 alone, Ben has helped his clients recover eight-figure settlements in three different cases. One of those settlements is believed to be the largest personal injury settlement in the history of Northwest Missouri. Insurance coverage and bad faith. Ben also handles cases where insurance companies refuse to live up to their promise to protect the people they insure. He fights to prove that the insurance policies provide coverage and that the insurance companies have breached their obligation to protect the people from whom they collected premiums. Ben holds insurance companies responsible for their bad faith when they wrongfully refuse to defend or settle cases against the persons they insure. Appeals. Ben handles all of the firms appeals. He has done appellate work in cases involving personal injury, property damage, workers compensation, insurance coverage, real estate disputes, fraud, and family law. Bens appeals have included appeals to the United States Court of Appeals for the Eighth Circuit, the Missouri Supreme Court, and the Missouri Court of Appeals. Ben enjoys the process of developing clear and compelling legal arguments to persuade appellate courts. Ben welcomes the opportunity to associate with attorneys outside the firm to help them with their appeals. COURTS ADMITTED TO PRACTICE Ben has been admitted to practice law in the state courts of Missouri and Kansas. He is also admitted to practice in the United States Court of Appeals for the Eighth Circuit, the United States District Court for the Western District of Missouri, the United States District Court for the Eastern District of Missouri, and the United States District Court for the District of Kansas. Ben received his Bachelor of Science degree in Natural Resource Conservation from the University of Montana. He attended law school at the University of Kansas, graduating in 2004. During law school, Ben served as Editor-in-Chief of the University of Kansas Law Review, and at graduation, he was honored with the Justice Lloyd Kagey Award for distinguished service in the law school. He is a member of the Order of the Coif. Ben is a member of the Missouri Association of Trial Attorneys and the Christian Trial Lawyers Association. PERSONAL INFORMATION Ben lives in St. Joseph, Missouri with his wife, Erin, and his three daughters, Isabelle, Ella Mae, and Frankee. Ben and his family are members at Cornerstone Baptist Church in St. Joseph, where Ben serves as a deacon and Sunday school teacher. In his spare time, Ben enjoys activities with his family, reading, running, and doing Cross Fit at B-Fit Cross Fit in St. Joseph.
