Gerald John Fitz

Profile John M. Fitzgerald is a trial and appellate lawyer who routinely manages complex commercial and governmental litigation in state and federal courts in Illinois and in other jurisdictions throughout the nation. At trial and on appeal, John represents clients in a variety of industries, including public accounting, construction, and manufacturing. John has two decades of experience assisting clients at every stage of litigation, arbitration and mediation. A 2004 graduate of the University of Chicago Law School, John joined Tabet DiVito & Rothstein in 2006 after working in the antitrust department of a large Chicago law firm. He has been a partner at Tabet DiVito & Rothstein since 2012 and an equity partner at the firm since 2023. John is one of the leading appellate lawyers in the State of Illinois and routinely briefs and argues high-stakes appeals. He served as the 53rd President of the Appellate Lawyers Association (ALA), an association of lawyers who practice in courts of review and judges who serve on those courts. He is a frequent author and commentator on issues involving appellate practice. For the past seven years, John has been recognized as a Super Lawyer by Super Lawyers magazine. This recognition is reserved for attorneys who have attained a high degree of peer recognition and professional achievement. In 2015, John was selected as one of the 40 Illinois Attorneys Under Forty to Watch by the Law Bulletin Publishing Company from a field of over 1,200 nominees. John frequently represents attorneys in disputes with their partners and law firms, and he regularly counsels attorneys on law practice transitions. John has served as an expert witness on the reasonableness of attorneys fees and has litigated significant disputes concerning attorneys fees and the validity of fee agreements. In addition to his regular legal practice, John has authored dozens of articles on current legal topics, and he is a frequent speaker and commentator on current legal topics. He is the author of A Guide to the Illinois Biometric Information Privacy Act, which was published in 2020 by the Illinois State Bar Association. It is the first published book to examine the Illinois Biometric Information Privacy Act and cases interpreting it. John co-authored the second edition of the Guide in 2021.
